AI Build vs. Buy: Evaluating Risks for Compliance Teams

Compliance teams are under more pressure than ever to modernize. Regulators are watching how programs are run, budgets are tight, and AI tools have made it easier than ever to prototype a workflow in days rather than months. It is not surprising that more teams are asking whether they can skip the vendor conversation entirely and just build what they need using tools already available to them.

It is a reasonable question, and the honest answer is: it is more complicated and more risky than it looks.

The logic is understandable. AI tools have lowered the barrier to building, existing enterprise licenses often include AI capabilities, and a custom-built system can feel like the more affordable and controllable option. IT and procurement teams push back on new vendor contracts when tools are already paid for.

What teams tend to underestimate is the gap between a working prototype and a compliant, scalable, defensible compliance program. That gap is where the real risks live.

 

What Gets Missed

Compliance is not a collection of isolated tasks. TPRM, gifts and hospitality, conflicts of interest, training, case management, policy management, and due diligence are all interconnected. A change in one area triggers requirements in others. AI tools can handle individual tasks; managing the relationships between those tasks, consistently and at scale, with a defensible record, is a fundamentally different challenge.

There is also a structural problem that surfaces repeatedly: the gap between what a compliance leader envisions and what an engineer can build. Translating "flag this transaction if it exceeds local thresholds and the approver has a prior relationship with the vendor" into reliable, auditable system logic requires precise specifications that someone has to define, test, and maintain. AI makes this feel more solved than it is. And once the build is complete, IT teams typically move on to other priorities, leaving compliance teams managing a system they did not build, without easy access to support when something breaks or a regulation changes.

Evaluating the Risks

Regulatory defensibility

The DOJ's updated Evaluation of Corporate Compliance Programs guidance is explicit: regulators expect companies to leverage data analytics and modern technology, and they expect to see how compliance decisions were reached. What data was used, what logic was applied, when it was documented. A model prompt chain is not a defensible audit trail. AI reasoning is probabilistic, not deterministic, and in an enforcement scenario, that distinction matters enormously.

Penalties for poorly-run compliance programs are significant: FCPA violations can carry criminal and civil consequences, the UK Bribery Act carries unlimited fines, and the EU's CSDDD can fine non-compliant companies up to 5% of yearly global turnover. The audit trail is not a secondary consideration; it is often what determines whether a compliance program is viewed as effective by regulators.

Security and data privacy

Compliance data sits among the most sensitive in any organization: third-party risk assessments, whistleblower reports, conflict of interest disclosures, due diligence findings. Running this data through general-purpose AI tools raises questions that most teams do not fully answer before deploying. Where does the data go? Is it used for model training? What are the retention and deletion policies? How is access controlled?

When internally-built systems are not monitored continuously and rely on manual processes, they frequently lead to non-compliance with internal policies and circumvention of controls. Gaps like insufficient access controls can result in data breaches or create opportunities for bad actors to exploit vulnerabilities. Purpose-built compliance platforms are built around SOC 2 certification, data residency requirements, and role-based access controls because their customers require it. Most in-house AI integrations are not built to those standards, and AI security and data governance requirements are evolving rapidly; what meets the bar today may not meet it in 12 months.

Maintenance and the moving-target problem

Regulations change, and AI models change too: updates, deprecations, and prompt drift can alter system behavior in ways that are not immediately visible. These two moving targets compound each other in ways that are difficult to manage without dedicated resources. IT teams have their own day-to-day priorities that frequently take precedence over compliance update requests. Compliance teams can find themselves waiting weeks or months for a system update, in the meantime falling behind on regulatory requirements. Building and maintaining software in-house also requires substantial ongoing investment; these expenses can surpass the costs of vendor-provided solutions, which benefit from economies of scale and shared development costs across many clients.

The true cost of ownership

The costs that do not show up in the initial business case are often the ones that derail the approach. Teams typically count API usage costs and initial development hours. What gets missed: ongoing prompt engineering as requirements change, QA and testing cycles every time a model or regulation updates, security reviews of the system itself, and compliance staff time spent managing the tool rather than doing compliance work. There is also the headcount question that rarely makes it into the initial business case: who monitors the system for errors, who handles exceptions, who trains new team members, and who owns updates when a regulation changes? With manual or pieced-together solutions, these line items add up significantly over time.

Some organizations attempt a middle road, combining an AI-built system with small, low-cost vendors to fill gaps. This tends to make things worse. Patchwork solutions create fragmented infrastructure, data silos, inconsistent reporting, and low adoption across the organization. The initial cost savings are typically outweighed by the long-term expenses of maintaining multiple systems and eventually migrating to something more robust. Most organizations find themselves purchasing a comprehensive solution anyway, making the patchwork approach a costly detour.

Scalability

What works for 50 third parties rarely works for 500. AI-built systems are typically scoped to immediate needs and do not account for scale in their initial design. Adding users, geographies, or risk domains to a custom system requires development resources and time that most compliance teams do not have. As organizations grow, the gaps become more visible and more expensive to close. Users forced to navigate multiple platforms with little consistency require more training, generate more questions, and create more friction in the compliance process.

Where AI in Compliance Excels

None of this means AI does not belong in compliance programs. The distinction worth drawing is between AI as an accelerant and AI as a replacement for operational infrastructure.

AI embedded within a purpose-built compliance platform can do meaningful work: automated risk scoring that updates as new information arrives, anomaly detection across large data sets, document analysis that speeds up due diligence review, and natural language search across policy libraries. These capabilities work because they sit within a system that already provides workflow structure, security controls, integration with external data sources, and a proper audit trail. The teams best positioned to benefit from AI in compliance are the ones with a solid operational foundation already in place. AI amplifies what is already there; it does not replace the infrastructure underneath.

Questions Worth Asking

Before committing to a build, these are the questions that tend to surface what matters most:

  • Who owns this system in 18 months if your AI vendor changes their model or pricing?

  • Can you produce a defensible audit trail from this system in a regulatory review?

  • Does this system meet your security and data residency requirements today, and will it as those requirements evolve?

  • Have you modeled the fully-loaded cost, including ongoing staff time, maintenance, security reviews, and eventual migration?

The teams that get the most out of AI in compliance are the ones who answer these questions before they build, not after.
